Duncans Jury Selection Delayed
Boise, Idaho — Jury selection in the Joseph Duncan sentencing phase is on hold until a mental health report is reviewed.
Duncan’s current attorneys formally objected with the process until the judge rules whether or not he’s competent to represent himself.
After Duncan asked to act as his own attorney, U.S. District Judge Edward Lodge ordered a report on his mental health.
Prosecutors support the delay because they claim proceeding without a decision on Duncan’s defense could be grounds for an appeal.
